1. General Provisions
1.1. These Terms and Conditions (hereinafter – the “Terms”) are a legally binding document that establishes the rights, obligations, and responsibilities between the Buyer and the Seller when purchasing goods in the online store www.domussensus.lt (hereinafter – the “e-store”).
1.2. The Buyer’s personal data is processed in accordance with applicable laws and the Privacy Policy, available on the e-store website.
1.3. Only legally capable individuals aged 18 or over, legal entities, or their authorized representatives may make purchases. Minors may only shop with the consent of a parent or legal guardian.
1.4. The Seller reserves the right to change, modify, or supplement these Terms at any time in accordance with the legal requirements of the Republic of Lithuania. Changes come into effect from the moment they are published on the e-store website.
2. Conclusion of the Sales Contract
2.1. A purchase and sale agreement between the Buyer and the Seller is considered concluded when the Buyer creates a shopping cart in the e-store, provides the delivery address, selects the payment method, confirms that they have read the Terms, and clicks the “Order” button.
3. Seller’s Rights
3.1. The Seller has the right to suspend or restrict the Buyer’s access to the e-store without prior notice if the Buyer violates the Terms or attempts to interfere with the store’s operation or security.
3.2. The Seller may unilaterally modify the Terms without notice.
3.3. The Seller reserves the right to cancel an order if payment is not received within two (2) business days.
3.4. All notifications will be sent to the email address provided by the Buyer during registration.
3.5. If the Buyer fails to accept the goods upon two delivery attempts, the Buyer shall reimburse the Seller for the resulting costs, as invoiced.
4. Seller’s Obligations and Liability
4.1. The Seller shall ensure proper access to the e-store and deliver the purchased goods within the agreed timeframe.
4.2. If the Seller cannot deliver a product, they will offer an equivalent replacement. If the Buyer refuses it, the Seller will refund the payment within 3–5 business days.
4.3. Refunds for returned goods shall be processed within 10 business days of receiving the returned product.
4.4. The Seller is not responsible for consequences arising from inaccurate or incomplete Buyer-provided data.
4.5. The Seller is not responsible for the content of external websites, even if the Buyer accesses them via links on the e-store.
4.6. Delivery times are indicative. In the event of delays due to out-of-stock items or other issues, the Seller will inform the Buyer.
4.7. The Seller is not liable for delivery delays caused by the Buyer or circumstances under the Buyer’s control.
4.8. Product images on the e-store may differ slightly in color, shape, or other parameters due to screen settings or lighting. Such differences are not considered non-conformities.
5. Buyer’s Rights
5.1. The Buyer has the right to purchase goods in accordance with the procedures outlined in these Terms.
5.2. The Buyer may withdraw from the sales contract within 14 business days from the date of receiving the goods by notifying the Seller in writing (via email) and indicating the order number and product(s) to be returned.
The returned goods must comply with the following conditions:
- unused and undamaged;
- in original and tidy packaging;
- with original labels and seals intact;
- not altered in appearance;
- with complete accessories and components;
- accompanied by a proof of purchase.
5.3. The Buyer has the right to update the information provided in their registration form.
5.4. All communications shall be sent via the contact details provided in the “Contact” section of the e-store.
6. Buyer’s Obligations and Liability
6.1. The Buyer agrees to these Terms and must comply with them and with applicable legal regulations.
6.2. The Buyer must pay for the goods and accept the delivery as per the Terms.
6.3. The Buyer cannot file claims regarding delivery to the wrong recipient if the provided delivery address was incorrect.
6.4. The Buyer is fully responsible for the accuracy of their submitted registration data.
6.5. The Buyer is responsible for all actions performed while using the e-store, whether intentionally or negligently.
6.6. The Buyer is responsible for the confidentiality of their login credentials. If third parties use the Buyer’s credentials, the Buyer assumes full liability for their actions.
6.7. Upon receiving goods, the Buyer must inspect the shipment with the courier and sign the invoice, waybill, or other delivery document. If the packaging is damaged or product defects/mismatches are found, these must be noted in writing and documented with the Seller’s representative. Failure to do so releases the Seller from liability for visible defects or packaging inconsistencies.
6.8. The Seller is not liable for any losses resulting from the Buyer’s failure to read these Terms, even if such an opportunity was clearly provided.
7. Prices, Payments, Delivery, Warranty
7.1. Product prices in the e-store and in the Buyer’s order are indicated in euros (EUR) and include VAT.
7.2. The Buyer can choose one of the following payment methods:
- via electronic banking (all responsibility lies with the Buyer’s bank);
- by bank transfer using a prepayment invoice;
- in cash upon delivery;
- via third-party payment services (e.g., Montonio).
7.3. The delivery period starts once payment is received, except for cash-on-delivery orders.
7.4. Goods are delivered by the Seller or its authorized representative.
7.5. Delivery fees are calculated based on location, weight, and whether carry-in service is requested.
7.6. The standard warranty period is 24 months for individual consumers and 12 months for legal entities, unless otherwise specified.
7.7. If the Buyer withdraws from the contract, they must cover the cost of returning the goods.
7.8. Claims regarding defective goods must be submitted within two (2) years of purchase, unless a different term is set by law or warranty.
8. Force Majeure
8.1. The Seller shall not be liable for failure to fulfill obligations or for delays due to force majeure events, including but not limited to natural disasters, war, pandemics, or government restrictions.
9. Final Provisions
9.1. Any disputes shall be resolved through negotiation. If negotiations fail, the Buyer may submit a complaint to the State Consumer Rights Protection Authority of the Republic of Lithuania (www.vvtat.lt).
